<div class="col-md-12"><p>Please find set out below are the Terms and Conditions, Waiver for cancellation and our Policy regarding participation on the Boat Trip. <br><br> In booking a trip, you agree to provide all members of your party with a copy of these Terms and Conditions, Waiver and Cancelation Policy, prior to taking part in the boat trip. <br><br> The carrier, Christina 3 island cruise, does not guarantee that the ship shall approach all advertised ports of call nor that it shall follow a specific sea route or time schedule. The captain and the carrier shall have the absolute right to alter or replace the advertised program or ports of call for any reason. <br><br> Should the ship be hampered or blocked for any reason, thus obliged to leave or not able to continue its predetermined route, the Carrier is entitled to transfer the passenger either to any other vessel, or upon his consent to any other means of transport, going in the direction of the passenger’s destination. <br><br> The passengers should abide by the ship’s departure times at each port. Should any passenger miss the ship at any of the ports listed in the cruise’s itinerary, the carrier shall in no case be liable for such an event, nor shall they be held responsible for the passengers’ alternative transportation. <br><br> Any kind of expenditure, including fines, penalties, fees, or other charges incurred by the carrier deriving from the passenger’s failure to comply with the ship’s rules or regulations or regulations of any Government or other authorities, shall be paid in full by the passenger to the carrier as soon as requested. <br><br><b> Bookings</b> <br> All reservations are pre booked with the carrier prior to the departure time and date. All Tours are subject to the weather conditions and passenger numbers. Where it is deemed necessary by Christina 3 island cruise or the captain, Christina 3 island cruise or the captain reserves the right to alter bookings without prior notice <br><br><b> Price Terms </b><br> Christina 3 island cruise reserves the right to apply an appropriate charge to its prices on any existing booking or new bookings (whether paid in full or not) due to economic changes (such as exchange rate, fuel prices etc.) that make a material difference to its pricing structure. A minimum of 14 days’ notice will be given before such a surcharge becomes effective. If the surcharge results in an increase of 10% or more to the price of the cruise then cancellation with a full refund will be allowed. Notification of the intention to cancel must be made within 10 days of the notification of the surcharge. Prices may vary due to offers, booking commissions, and partners etc.. The carrier chas np obligation to make refunds when a change in prices may occur. <br><br><b> Cancellation & Refunds </b><br> Cancellations will be accepted via email up to 48 hours until the departure day prior to departure. No refunds are provided for missed departure times or booking. No refunds will be issued without a minimum of 48 hrs prior to notice being received in writing via email. Cancellation due to the weather condition, mechanical or medical reasons christina 3 island cruise will try to reschedule your cruise. If you refuse, full refund of deposit or the price of the ticket in the case that it is fully paid, less credit card transaction fee.In case the trip is delayed, or cut short due to weather, mechanical breakdowns, or medical emergency, fees will not be refunded. We will not be held financially responsible for an alternative trip or accommodation, any inconvenience incurred, or for adverse weather conditions or illness as a result.The sailing of the boat is unconfirmed until minimum numbers are booked. the carrier will try to offer another boat of the same standard. If no alternative boat is available then we will reschedule your day’s cruise or a full refund of deposit less credit card transaction fee will be issued.In the case of refusing to take the cruise, due to personal considerations to the weather conditions, then we will try to change your cruise days if your schedule permits, however we can’t guarantee you’ll be able to change the cruise days therefore fees will not be refunded.Rainy or cloudy weather are no valid reasons for cancellation by client, fees will not be refunded. <br><br><b> Arriving on Time</b> <br> Passengers must arrive at the departure point fifteen minutes before the allotted departure time. Failure to arrive on time may result in a refusal to board the vessel. Departure times will not be delayed due to the late arrival of passengers. No refunds will be issued for cancellations of bookings resulting from the late arrival of passengers. <br><br><b> Loss or Damage to Personal Property </b><br> Passengers travelling on the ship are responsible to take care of their personal belongings while aboard. The carrier takes or has no responsibility for any loss or damage to any personal belongings of passengers during the tour. Every passenger is completely responsible for safeguarding their own personal belongings. Where a personal item is dropped and falls into a difficult or inaccessible part of the boat, where it is not possible to reach in a timely fashion, it may not be possible to retrieve the item immediately. The carrier accepts no responsibility for such items. However, Boat Trips will endeavor to retrieve and return the item as soon as is possible given the busy scheduling of the service. Particularly in this regard, the passenger accepts and assumes full responsibility for any loss or damage to the item. When a personal item is dropped overboard, it is not possible to guarantee the return of the item. Therefore, the carrier accepts no responsibility for such items and the passenger hereby accepts and assumes full responsibility for any loss or damage. We advise not to bring anything with you that you are fearful of losing.” In particular, items such as handbags, engagement rings, sunglasses, hats, phones, money and watches that can easily drop overboard. The carrier accepts no responsibility in this regard whatsoever. <br><br><b> Passengers and behavior </b><br> Passengers must at all times obey the instructions of the Captain ,Crew member and Employee of the carrier, Christina 3 island cruises. The safety of passengers, crew and boat are paramount. Children must be accompanied by a responsible adult at all times. This adult is responsible for the behavior, conduct and safety of the child throughout the entire boat trip. Passengers, both adults, and children must remain seated throughout the entire boat trip. Standing or walking around onboard is not permitted, with the exception of boarding and disembarking the boat. Neither the carrier nor the ship shall be liable for any loss of life or personal injury that may occur at any time and at any place when the passenger has boarded, is ashore, whilst at an intermediate port, either after disembarking at the final port. For such events which take place on board the ship, the carrier is liable only if the interested party shall be able to prove that this event was caused due to gross negligence of the carrier or his employees. <br><br> We recommend that women in the early stage of pregnancy, up to the 12th week, seek medical advice before traveling. Women who have completed or will complete the 28th week of their pregnancy at any stage of the cruise should present a medical certificate confirming their fitness, i.e. ability to travel. The carrier reserves the right to request a medical certificate at any stage of pregnancy and to refuse transportation should the carrier and/ or the captain show any doubt that the passenger shall be safe during the cruise. <br><br> The passenger must not carry on board any illegal substances or other illegal items, such as knives, guns, weapons of any kind, flammable or hazardous objects, nor any other prohibited substance. Not complying with the rules constitutes a violation of the present terms and renders the passenger strictly liable towards the carrier for any injury, loss, damage or expense, thus the passenger shall be liable to compensate the carrier for any claim, fine or financial penalty arising from this breach (including but not limited to legal costs or other expenses relating to the treatment of such claims or carrying out procedures relating to the imposition of fines or penalties on the basis of full compensation). The passenger may be liable to statutory fines or other sanctions. <br><br> All firearms and any other weapon of any kind are prohibited on board. The captain and/ or the carrier shall be entitled to confiscate, retain, or take any other measures in relation to such weapons. Those persons carrying or handling such objects may have to disembark without any further liability of the carrier. <br><br> In order to ensure that the carrier is able to carry passengers safely and in accordance with applicable safety requirements imposed by international, European or national law and in order to comply with the safety requirements imposed by the competent authorities, including the administration of the state flag the passenger declares and guarantees that he/ she is mentally and physically fit to travel and that his / her behavior shall not endanger the safety of the ship nor he/ she shall harass the other passengers. <br><br> Any Passenger with mental or physical disability of any kind or with symptoms of mental or physical illness of any kind, which may affect his/ her ability to travel, must present a medical certificate before the ship’s departure certifying the ability of the passenger to travel. <br><br> In case of illness or accident, passengers may be transported ashore by the carrier or the captain for medical care. The carrier assumes no liability as to the quality of medical care in any port or place of disembarkation of the passenger. Passengers are advised to take out an insurance policy covering medical care and emergency airlift or other means of returning to their home. The carrier does not undertake any liability for medical facilities ashore. The medical facilities and standards of care vary from port to port. The carrier therefore makes no statement, nor guarantee of the quality of medical care received ashore. <br><br> The carrier does not accept unaccompanied minors under the age of 18 on the date of departure and children are not permitted to board the ship without being accompanied by a parent or guardian. While on board children must remain under the supervision of a parent or guardian at all times and are welcome to take part in the activities on board or in land excursions as long as a parent or guardian is present. Children are not allowed to remain on board the ship should the parent or guardian go ashore. <br><br> The passenger agrees to comply with the corporate standards and regulations of the carrier as well as all the commands and instructions of the ship’s captain and officers. <br><br> No animals and/ or pets are allowed on board, with the exception of animals certified as escort aids for the blind. <br><br><b> Wearing of Lifejackets </b><br> In an emergency all passengers will be provided with approved lifejackets. These must be worn at all times by all persons. Persons damaging or activating a lifejacket in a non-emergency, will be liable for the replacement cost of €100 per lifejacket. <br><br><b> Refusal to Board </b><br> Christina 3 island cruises and its staff reserve the right to refuse boarding or require a person(s) to disembark the vessel if staff believed that they are a danger to the safety of themselves, others, or members of crew. In addition, if they have, or are threatening to engage in, behaviour that may adversely affect the safety, enjoyment, comfort, or well-being of others. This may include but is not limited to disruptive behavior that is verbally or physically abusive, harassing in nature, obscene or discriminatory. Also, failing to or refusing to follow the terms & conditions set out by Christina 3 island cruises, its safety rules, or the instructions of the Captain or crew members. In such an event, Christina 3 island cruises will not be required to refund the fare or part of and the financial deficit will be bore solely by the passenger. In addition, Christina 3 island cruises will be entitled to recover from them any costs or expenses incurred by it, its representatives or crew members. <br><br><b> Assumed Risk</b> <br> Passengers should be aware that medical facilities and access to emergency assistance, other than basic First Aid, are not readily available during the boat trip. Therefore, you should be willing to accept the risks and uncertainties involved as being an integral part of the boat tour. Passengers thereby must accept and assume full responsibility for any and all risks of loss, illness, injury or death while taking part in the boat trip. In particular, all passengers or of those in their care, are accepting the waiver set out below exempting BoatTrips.ie from all claims of negligence or other, whatsoever. In particular, Christina 3 island cruises accepts no liability for any direct or indirect loss or damage, foreseeable or otherwise, arising from the use of the boat or any equipment or facilities, either in contract or tort, including negligence, or breaches of duty of care arising from the boat tour. <br><br><b> Force Majeure </b><br> In the case of a Force Majeure event, Christina 3 island cruises will be released from any liability of any kind and accepts no liability for any loss or damage in whole or in part resulting from an “Act of God” (Force Majeure event) or any other condition outside its control. <br><br><b> Changes in Terms & Conditions </b><br> From time to time, the Terms and Conditions may be changed by Christina 3 island cruises without notice. Any changes will come into effect upon publication. <br><br><b> Waiver</b> <br> In participating on the boat trip, I agree that I take part at my own risk and that (to the fullest extent permitted by the law) no person(s) or organisation(s) will be held responsible for any expense, accident, injury or loss to myself or person in my care, prior to, during or after the boat trip/event. In particular, I confirm that neither the carrier, their officers, employees, associates, volunteers or agents shall be, nor shall be deemed to be, responsible or liable (whether in contract or in tort or under any statute whatsoever), for any pain and suffering, injury, illness or other mishap to myself or my property, my family or dependents, sustained in, or arising from or out of, or in any way directly or indirectly connected with the boat trip and I, for myself, my heirs and executors, hereby expressly waive, release and forever discharge all of the above named from any liability arising out of my participation in this boat trip adventure. I am aware of and assume all risks associated with participating in this boat trip adventure, including but not limited to water immersion, drowning, falls, contact with other participants (including Covid 19), conditions of the boats, conditions of the rivers/canals, conditions of the roads, lands, river/canal banks, conditions of jetties, pontoons, moorings, slipways and docking areas. I understand that this waiver includes any claims, whether caused by negligence, the action or inaction of any of the above parties, or otherwise. I acknowledge that none of the above named shall be liable for the actions of any third parties. By accepting these terms, I agree to and will adhere to the direction of the carrier’s, Christina 3 island cruises, employees or agents. I hereby grant full permission to any and all of the above named parties to use and reproduce any images or recordings whatsoever, fixed or moving, taken of me (or those under my supervision & responsibility, on this boat trip for any legitimate purpose, including but not limited to, the advertising, promotion or exploitation of the boat trip (and future trips) through the medium of television, film, video or other media broadcasts. This permission is considered unlimited and may be used the world throughout. I confirm that all intellectual property in connection any such images or recordings shall remain the property of Boat Trips trading as Christina 3 island cruises and where such intellectual property does not automatically vest in Boat Trips, these Terms and Conditions shall constitute a legally binding assignment thereof, and I consent to the signing of all reasonable documentation required to give effect thereto. I consent to Boat Trips holding and using all personal information disclosed by me, or on my behalf, in conjunction with my participation in the boat trip and I agree that Christina 3 island cruises can use my personal information to contact me. I understand that participating in this event is physically demanding, potentially hazardous and acknowledge the risks involved. I also acknowledge that I should not take part and participate unless I am physically and medically able to do so. I confirm that I have no physical or medical disabilities or impairments which would endanger myself or others taking part. To the extent permitted by law all provisions of these Terms and Conditions shall be severable and no provision shall be affected by the invalidity or unenforceability of any other provision with the remaining provisions if necessary, being so amended as shall be necessary to give effect to the spirit of these Terms and Conditions so far as possible. In the case of a minor or person in your care, please accept these terms and conditions of participation t on their behalf. <br><br> Every disagreement and issue by any means raised between the passenger and the carrier with regard to the transfer, including, without limitation, the execution of the transportation and the implementation of these terms, shall be governed by the Greek law and shall be subject to the provisions of the Athens Convention and shall be heard before the Courts of Kos, Greece, unless the carrier concurs otherwise expressly and in writing.</p></div>
